Meaning.
Connotation. Mere nomenclature is not a decisive factor in determining the nature and meaning of surcharge or charge. The Court must look to the attending factors and circumstances of the case, the reality involved in it, the conduct of parties, the manner and object of levy and then decide what in effect is this levy.
