ACT XIII of 2010 ACT XIII of 2010 BALOCHISTAN INDUSTRIAL RELATIONS ACT, 2010 An Act to consolidate and rationalize the law relating to formation of trade unions, and improvement of relations between' employers and workman [Gazette of Balochistan, Extraordinary, 22nd February, 2011] No. PAB/Legis: V (14)/2010, dated 26-10-2010.--Balochistan Industrial Relations Bill No.14 of 2010 having been passed by the Provincial. Assembly of Balochistan on 14th October, 2010 and assented to by the Governor, Balochistan on 15th October, 2010 is hereby published as an Act of the Provincial Assembly of Balochistan. Whereas it is expedient to consolidate and rationalize the law relating to formation of trade unions, regulation of relations between employers and workman and the avoidance and settlement of any differences or disputes arising between them or matters connected ' therewith and ancillary thereto; It is hereby enacted as follows:-- 67. Protection of certain persons.--(I) No person refusing to take part or to continue to take part in any illegal strike or illegal lock-out shall, by reasons of such refusal, be subject to expulsion from any trade union or to any fine or penalty or to the deprivation of any right or benefit which he or his legal representatives would otherwise have been entitled, or be liable to be placed in any respect, either directly or indirectly, under any disability or disadvantage as compared with other members of the trade union. (2) Any contravention of the provisions of subsection (1) may be made the subject-matter of an industrial dispute, and nothing in the constitution of a trade union providing the manner in which any dispute between its executive and members, shall be settled shall apply to any proceedings for enforcing any right or exemption granted by sub-section (1). In any such proceeding, the Labour Court may, in lieu of ordering a person who has been expelled from membership of a trade union to be restored to membership, order that he be paid out of the funds of the trade union such sum by way of compensation or damages as the Court thinks just.
