Contentions of accused were that while granting leave to appeal Supreme Court had observed in its judgment that case of accused was identical to that of a co-accused, who had already been acquitted by the Trial Court; that he was in jail for the last about seven years, and keeping in mind that his sentence had been reduced to life imprisonment, his sentence should be suspended pending disposal of his petition for leave to appeal

Validity

Supreme Court had granted leave to appeal with the observation that co-accused who had been attributed a role identical to that of the co-accused, had been acquitted by the Trial Court

Accused was behind bars since date of his arrest (about seven years)

Sentence of accused was suspended pending disposal of his petition for leave to appeal before the Supreme Court and he was admitted to bail

Petition was allowed accordingly.
