Syed Muhammad Anwar Shah for Petitioner Ch. Abdul Nabi for the State The petitioner has been arrested under section 10/16 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979. He has petitioned for being released on bail.

2. According to the facts narrated,, in the F.I.R. the wife of Ghulam Mustafa complainant was abducted by Abdul Majeed and others. Abdul Majeed had developed material ties with Mst. Murad Khatoon, the complainant's wife, and she was subsequently abducted for the purpose of rape. The name of Kalo petitioner has been mentioned as he aided Abdul Majeed in the abduction of Mst. Murad Khatoon. In case, Mst. Murad Khatoon was a consenting party and had developed illicit liaison with Abdul Majeed then there was no difficulty for her abduction by Abdul Majeed. Allah Diwaya to whom a similar role of assistance in the abduction of Mst. Murad Khatoon was assigned has been released on bail. The principle of consistency demands that Kalo, who is the real brother of Abdul Majeed, should also be released on bail.

3. I, therefore, release him on bail in the sum of Rs.40,000 with one surety in the like amount to the satisfaction of Assistant Commissioner/Duty Magistrate, Liaqatpur, till the disposal of the case against him. H.B.T./K-249/L Bail granted
