Registration of document

When document creates an interest in property, such document requires compulsory registration.

Registered document operates from time when it was presented and executed before concerned Sub-Registrar after completing all codal formalities and payments of required duties, taxes and fees etc., and not from date of registration of document.

Section 17 of the Registration Act, 1908, provided that gift instrument regarding immovable property or other non-testamentary instruments which purported or operated to create, declare, assign, limit or extinguish whether in present or in future any right, title or interest whether vested or contingent were compulsorily registrable.
