Discretion vested in plaintiff to institute on basis of such cheque either suit under O.XXXVII, C.P.C. or ordinary/regular civil suit
Filing of such ordinary/regular civil suit would not deprive plaintiff of benefit of presumption attached to negotiable instrument under S.118 of Negotiable Instruments Act, 1881.
