In absence of original design, Enquiry Officer could not have expressed any opinion one way or other about its correctness or otherwise

Competent Authority's approval of detailed estimates and designs, his subsequent inspections of the site, consensus with Special Committee's report and admission during preliminary enquiry that design had been approved by him in principle, .indicate only one thing that the design had his tacit, if not express, approval

Charge against civil servant that he got foundation of the building constructed without getting the design approved by Competent Authority was not established in circumstances.

Employee of Government department governed by Government Servants Efficiency and Discipline Rules, held, was not within ambit of the Ordinance.
