Vires of North-West Frontier Province Hasba Bill, 2005

Sections 10(ب)(ج)(د), 12(1)(ا), (ب) & (ج), 23(1), (2), (3), (5), (6), (7), (12), (14), (27), 25(1) (2) and 28 of the "Hasba Bill", 2005, passed by the Provincial Assembly of N.-W.F.P., are ultra vires the Constitution, therefore, the Governor of the N.-W.F.P. may not assent to the "Hasba Bill" in its present form. Judgment & Decree

IFTIKHAR MUHAMMAD CHAUDHRY, C.J.

For the reasons to be recorded later, in our considered opinion, sections 10(ب)(ج)(د), 12(1)(ا), (ب) and (ج), section 23(1), (2), (3), (5), (6), (7), (12), (14) & (27), section 25(1) & (2) and section 28 of the "Hasba Bill", 2005, passed by the Provincial Assembly of N.-W.F.P., are ultra vires the Constitution, of Islamic Republic of Pakistan, 1973, therefore, the Governor of the N.-W.F.F. may not assent to the "Hasba Bill" in its present form. M.B.A./R-38/S Order accordingly.
