Judgment & Decree
Shafiq Ahmed Qureshi for Petitioner. Mahmood Abdul Ghani, Representative for Respondent. Date of hearing: 16th October, 1989. This is a Transfer Application under section 38(7) of the I.R.O., 1969, for transfer of Case No.l of 1987, pending before Sindh Labour Court No. II to Sindh Labour Court No. III, Karachi.
2. I have heard Mr. Shafiq Ahmad Qureshi, learned counsel for the applicant union and Mr. Mehmood Abdul Ghani learned representative for the respondents.
3. The case was originally filed in Sindh Labour Court No. II. Because it was lying vacant it was transferred to Sindh Labour Court No. IV where it proceeded. It appears that on the application of the respondents it was again transferred to Sindh Labour Court No. 11, when Presiding Officer, was appointed. Now again Sindh Labour Court No. II falls vacant hence this prayer.
4. The main contention of Mr. Shafiq Ahmad Qureshi is that this is an Industrial dispute under section 32 (I-A) of the I.R.O., 1969, which requires to be disposed of early and it is not known as to when the Presiding Officer, Sindh Labour Court No.II may be appointed and further in another dispute between the same parties an application under section 34 of I.R.O., 1969, has been moved by the respondents which has been transferred by this Tribunal from Sindh Labour Court No. II to Sindh Labour Court No. III.
5. In view of the above circumstances in the interest of justice order that Case No. 1 of 1987; pending in Sindh Labour Court No. II be transferred to Sindh Labour Court No. III, Karachi, for disposal according to law M.Y.H./1557/Lb.S Order accordingly.
