Anwarul Hassan Khan 8hatti for Appellant. Date of hearing :19th April, 1982. This appeal arises from the decision, dated 28th February, 1982 passed by the Presiding Officer, Punjab Labour Court No. 9, Multan whereby the Grievance petition of the appellant was dismissed for his reinstatement.

The appellant was a Baildar and after serving for 30 years was retired on 4th May, 1980 on the strength of Medical Report of the Medical Superintendent which was to the effect that he was of the age of more than 60 years, that he was suffering from Senial Debility. No counter‑Medical Certificate was produced by the appellant to show that he has not yet reached the age of supperannuation and that he was not suffering from the disease as reported by the Medical Superintendent in his Certificate. In these circumstances the appellant was rightly retired and his grievance peti tion was rightly dismissed. There is no force in the appeal which is dismissed in limine. M. Y. M. Appeal dismissed.
