Revision No. 1421 of 1970‑71, decided on 12th October 1971, District Bahawalnagar. State land‑Allotment of ahata‑Petitioner running a shop in ahata and paying rent for same Ahata ordered to be allotted to petitioner on rent under usual conditions. Akhtar Ahmad Shah for Petitioner. Arguments heard. The facts briefly are that the shop in dispute was allotted to one Ibrahim who sold its malba to Sajawara the petitioner and vacated in his favour. The Collector however declared Sajawara as an unlawful occupant and the shop was resumed. Sajawara and Ibrahim both went in appeals before the Commissioner who after giving them an opportunity of being heard upheld the order of the Collector. Hence this revision petition.
2. The petitioner contends that he is paying the rent for this shop and has produced receipts Nos. 2 and 32 dated 25‑9‑1970 and 28‑5‑1971 in proof of payment. He has produced a report from the Chairman, Union Council saying that he is running a shop in this Ihata. In the circumstances he should be allowed to keep the Ihata which should be allotted to him on rent under the usual conditions of allotment. Order accordingly.
