(1) Granted.
2. By this application, under Order XXIII, rule 1, C.P.C., moved by the attorney of the plaintiff, he has sought unconditional withdrawal of Suit No.446 of 2001. Mr. K.A. Wahab has no objection. Suit No.446 of 2001 is accordingly dismissed as withdrawn with no order as to costs.
3. Office has wrongly placed this application, under Order XXIII, rule 3, C.P.C., in the file of Suit No.446 of 2001. It is, therefore, ordered that this application may be taken out from the file of Suit No.446 of 2001 and be placed in the file of connected Suit No.114 of 2001. By this application, under Order XXIII, rule 3, C.P.C., duly signed by the plaintiff, her counsel Mr. K.A. Wahab, attorney of the defendant and his counsel Mr. Iftikhar Javed Qazi, disposal of Suit No.114 of 2001 is sought in the terms as recorded in the said application. This application is allowed as prayed and consequently Suit No.114 of 2001 is also disposed of in the terms as recorded in the compromise application. H.B.T./S-59/K Order accordingly.
