Judgment & Decree
The applicants are involved under F.I.R: No.276 of 1988 for allegedly possessing forged passports in which they have been admitted to bail by the trial Court. This application for bail before arrest has been filed as after the lodging of first FIR after the expiry of about five months second FIR No:338 of 1988 has been filed in which it has been alleged that it had come to light that the applicants had received amounts from the persons intending to go to Gulf State. The applicants were admitted to interim bail on 22-9-1988 in pursuance of an order passed by Mr. Justice (Retired) Ahmad Ali U. Qureshi. The case has come up for hearing several times since then and has been adjourned from time to time for want of production of the police papers. Mr. Abdul Hafeez Lakho learned Advocate-General submits that even today the police papers are not available and since the applicants have remained on interim bail for quite some time, he will have no objection to the confirmation of interim bail provided the applicants appear on each date of hearing in the trial Court in connection with the above second FIR in addition to the first FIR and will cooperate with the Investigating Agency if and when called by them, failing which it will be open to State to move an application for the cancellation of bail. The interim bail is confirmed on the above conditions. SA./B-128/K Bail confirmed.
