S. 13--Sentence, reduction in--Petitioner sentenced to seven years in connected case and for three years in the present case, but sentences ordered to run consecutively--Petitioner having served sentence in connected case after earning remission on account of good conduct and further for a little over one year in the present case, sentence reduced to period already undergone. Muhammad Hanif Khitana for Petitioner. S. M. Hamid for the State. Nazir Ahmad has come up in appeal against his conviction under section 13 of the Arms Ordinance. He was sentenced to three years R.I. on 31-10-1982. Appellant was found in possession of an unlicensed revolver EXh.P.1 and six live bullets P.211-6, which were taken into possession vide memo. P.A. attested by P . W .1 Nazir Ahmad A . S .I . and P.W.2 Abdul Rashid. They have fully corroborated each other. Reduction of sentence in this case is prayed for. Learned counsel for the appellant contended that in the connected case under the Hudood Ordinance, the appellant was sentenced to 7 years' R.I. with a fine of Rs.10,000 and on account of his good conduct in the jail he has earned the maximum remission. He has also paid up the fine. Since the sentence in this case is to run consecutively as such the appellant's sentence in this case has started running and according to his calculations he has served a little over a year in this case. Under the circumstances his sentence is reduced to a period already undergone. S. G. D. Order accordingly.
