The impugned order, dated 18‑1‑2001 was passed on application whereby witnesses along with documents were summoned. Somehow photocopies of documents have already been brought on record but witnesses sought to be summoned were not allowed to be summoned. This revision application has called in question the refusal to summon the witnesses. The learned counsel of applicant union, is prepared to withdraw the revision application on the condition that if the photocopies of documents which are available on record are questioned at subsequent stage and their genuineness was challenged, the applicant would be allowed to make application for summoning the witnesses to prove the‑genuineness of the documents. The learned counsel for the respondent No.2 has no objection to this proposal. In view of the arguments of both the learned counsel, as stated above, the revision application is dismissed as withdrawn subject to the condition that if the photocopies of the documents which are already available on record are challenged at subsequent stage the applicant will be free to summon the concerned witnesses to prove the genuineness of the documents. Order accordingly. H. B. T./75/KLT Revision application dismissed.
