Accused was found innocent during investigation and a report of his discharge was made-- Investigation was verified and found correct by the Deputy Superintendent of Police

Judgment & Decree

Jaffar petitioner alongwith three others is charged for the murder of Sanatta deceased and for causing injuries to Mst. Fateh Bibi P.W. on 12-5-1989 with blunt weapons.

2. He has applied for bail on the ground that he had been found innocent in the investigation and that a report of his discharge was made by the police, which was not accepted by the Ilaqa Magistrate.

3. During investigation it transpired that Sarwar co-accused had hired one Zafar son of Barket Ali and that they both had killed Sanatta and a Hathaura allegedly used in the occurrence was recovered from Zafar aforementioned. The g investigation was verified by the local D.S.P. who also confirmed the opinion of the Investigating Officer about the innocence of the petitioner.

4. In the circumstances discussed above, I admit the petitioner to bail in the sum of Rs.25,000 with two sureties in the like amount to the satisfaction of A.C:I Okara. S.A./J-68/L Bail granted.
