Acquisition of land

Nothing was available to indicate that property of petitioner was acquired by authorities for the purpose of construction of public purpose

Nazir of the court had reported that it was located at some distance from the land being acquired

Petitioner's property was not being acquired, however, if it was decided to acquire the same, that would be done only in accordance with law and on payment of appropriate compensation to the petitioner

Counsel for the petitioner being satisfied, petition was disposed of accordingly.

Judgment & Decree

Apparently, there is nothing to indicate the petitioner's property is acquired by the respondent for the purpose of construction of Lyari Express, and the Nazir has reported that it is located at some distance from the river bed of the Lyari River. Mr. Manzoor Ahmed stated that there is nothing on record of City District Government Karachi, indicating that the petitioners' property is being acquired. However, it is eventually decided to acquire the same, will be done only in accordance with law and paying appropriate compensation to the petitioner. Learned counsel for the petitioner is satisfied and the petition is disposed of. H.B.T./M-198/K Order accordingly.
