Criminal Miscellaneous in Criminal Appeal No. 459 of 1981, decided on 1st September,‑ 1981. ‑‑‑ S. 426 ‑ Sentence, suspension of ‑ Petitioner sentenced to 5 years' R. I. and fine of Rs. 5,000‑Appeal already admitted to regular hearing‑Petitioner prepared to pay amount of fine to heirs of deceased‑Sentence suspended on petitioner's depositing amount of fine in circumstances of case. Awan Muhammad Hanif Khan for Appellant. Nazar Hussain Dogar for the State. S. H. O. has not produced Alam Khan son of Babu Khan caste Rajput complainant. The learned counsel submits that the petitioner, is prepared to pay the amount of fine of Rs. 5,000 to the heirs of the deceased Ghulam Qadir. The appeal has already been admitted for regular hearing. The sentence is 5 years R. I. In these circumstances the execution of sentence is suspended provided the petitioner deposits Rs. 5,000 (as offered by him) before the trial Court which the trial Court would pay to the heirs of the deceased after verification and furnishes bail bond the sum of Rs. 10,000 with one surety in the like amount to the satisfaction of the trial Court. M.Y.M. Sentence suspended.
