Criminal Transfer Application No.11 of 1991, decided on 16th June, 1991. ‑‑‑‑S. 526‑‑‑Prohibition (Enforcement of Hadd) Order (4 of 1979), Art.3/4‑‑ Transfer of case‑‑‑Quantity of heroin recovered from each accused was ten grams and as such the case was triable by a First Class Magistrate‑‑-Case was consequently transferred from the Court of Additional Sessions Judge to the Court of competent Magistrate for further proceedings in accordance with law. Learned counsel for the applicants contends‑ that from the three accused persons, the quantity of heroin recovered was only 10 grams each and I as such the case was triable before a First Class Magistrate. It is, accordingly, contended by the learned counsel that thr, case may be transferred from the file of VIth Additional Sessions Judge, Karachi to F.C.M. Jamshed Quarters (Hudood) Karachi. The application is not opposed by the learned Assistant Advocate‑General, Sindh. It is, accordingly, directed that Criminal Case Not/90 (State v. Raza Muhammad) be transferred to the Court of F.C.M. 8 Jamshed Quarters (Hudood) Karachi, fir further proceedings in accordance with law. N.H.Q./G‑278/K Case transferred.
