Motor Vehicle‑Private carrier's permit‑Applicant brick kiln owner and Government contractorRefusal to renew unjustified,

Judgment & Decree

AKHTAR HUSSAIN, F. C.--‑The renewal of the Private Carrier's permit of the appellant was refused by 'the Regional Transport authority on the ground that he was a brick‑kiln owner and as such he did not require a Private Carrier's permit. My attention has been drawn to the application of the appellant for the renewal of his permit, in which he had noted that he was a Government Contractor besides being a brick kiln owner. He did not require his vehicle merely for his Brick‑kiln, but also needed it for carrying out the other business as a Contractor of the Defence and Railway Departments. I, therefore; do not see that the refusal of the renewal of his permit by the Regional Transport Authority was justified and therefore, accept the appeal and direct that the appellant's permit for a Private Carrier should be renewed. Announced. A. H. Appeal accepted.
