Criminal Miscellaneous No. 1175/B of 1988, decided on 19th April, 1988. ‑‑‑S. 497‑‑Offence of Zina (Enforcement of Hudood) Ordinance (VII of 1979), Ss.10 & 11‑‑Bail, grant of‑‑Accused, a lady going away and married of her own free will‑‑Accused having suckling child aged about a month‑‑Bail allowed in circumstances. S. M. Rashid for Petitioner. Nemo for the State. The petitioner is accused of offences against Sections 10 and 11 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979. She is being tried on the report of her father Muhammad Ahmad which was made on 2‑10‑1987. According to that report, the petitioner was taken away by Abdur Razzaq accused on 16‑9‑1987. The report was made on 2‑10‑1987. Later, the petitioner was arrested and her statement under section 164 Cr.P.C. was recorded. In that statement, she said that she was in love with Abdur Razzaq, had left with him for Karachi and had married with him there of her own free will. In her statement under section 164, Cr.P.C., it is significant to note, she gave her age as 17 years. She gave birth to a child about a month ago in jail. In view of her sex and the fact she has a suckling child aged about a month, I allow her to be released on bail on her furnishing bond in the sum of Rs. 10,000 (Rupees ten thousand) with one surety in the like amount to the satisfaction of A.C/Illaqa Magistrate concerned. S.A./Q-14/L Bail allowed.
