(On appeal from the order of the Lahore High Court, Lahore dated 25‑9‑1993 passed in Cr.M. No. 1/93 in Cr. A. No. 568/93). ‑‑‑‑S. 5(2)‑‑‑Penal Code (XLV of 1860), 5.161‑‑‑Criminal Procedure Code (V of 1898), S.426‑‑‑Constitution of Pakistan (1973); Art. 185(3)‑‑‑Suspension of sentence‑‑‑Sentence of two years' R.I. was passed on the accused two months back‑‑‑Considering the period of sentence awarded petition for leave to appeal was converted into appeal, the operation of the sentence was suspended and the accused was released on bail. Muhammad Sharif for the State.

Judgment & Decree

SALEEM AKHTAR, J.‑‑‑The petitioner has been convicted and sentenced under section 161, P.P.C. read with section 5 (2) of the Prevention of Corruption Act, 1947 to two years' R.I. with a fine of Rs.10,000 in default to further six months, R.I. by the learned Special Judge, Anticorruption, Gujranwala. The sentence was passed on 20‑9‑1993 and he applied for its suspension which was refused by the impugned order. Considering the period of sentence awarded, we convert this petition into an appeal and suspend the operation of the sentence on petitioner furnishing two sureties in the sum of Rs.25,000 each to the satisfaction of the trial Court. N.H.Q./Z‑161/S Sentence suspended.
