Judgment & Decree
FAZLE-AKBAR, J.-Since 1956, the members of the petitioner Society, who are shopkeepers, were carrying on their business in the open plot around the Church Compound, Sadar, Karachi, In exercise of the powers conferred by Municipal Administration Ordinance, 1960, the Karachi Municipal Corporation directed the shopkeepers to remove their shops from the said compound. The shopkeepers then challenged the above order by moving a writ petition in the High Court, but the same was dismissed. They now seek special leave to appeal against the order of the High Court. The learned Counsel for the petitioners has, however, stated that as the members of the petitioner Society have already been turned out of the disputed land, this petition has become infructuous. This petition is, therefore, dismissed. Petition dismissed.
