Defective car warranty claims - Consumer Court decisions

I bought a brand new car from a dealership. Within 5,000 km, the transmission failed. The company is delaying replacement, saying parts are out of stock. What are my rights?

Under the Punjab Consumer Protection Act, if a product is defective and cannot be repaired, you are entitled to replacement of the product or return of the price. You can file a case in the Consumer Court. Courts have previously ordered major car manufacturers to replace entire vehicles or refund full payments plus damages for mental agony due to manufacturing defects.
