Facts of case showing lack of `mens rea' on part of convict
Sentence of convict suspended in circumstances. Rao Hamid Mukhtar Khan for Petitioner Nemo for the State For the purpose of suspension of sentence, learned counsel contended, that the quarrel started over the cutting of branches of trees. The petitioner, a' shepherd, was alleged to be armed with Kulhari, he inflicted a solitary biow which resulted in the death of Muhammad Siddique. Learned counsel submitted that this fact shows lack of `mens rea' on the part of the petitioner. The submission is not without force, hence the sentence of the petitioner' is suspended subject to his furnishing security in the sum of Rs.50,000 (Rupees fifty thousand only) with one surety in the like amount to the satisfaction of the Assistant Commissioner, Gujranwala. H.B.T./S-613/L Sentence suspended.
