(From. the judgment/order of the Federal Service Tribunal, Islamabad Camp at Karachi, dated 20‑7‑1989, passed in Appeal No. 145‑K/1985). ‑‑‑Art. 212(3)‑‑‑Leave to appeal was granted to examine the question of law whether the Proforma promotion of petitioner in Grade‑17 with effect from specified date had been made subject to his passing the promotion examination when no such examination was prescribed for promotion under the Rules as on 12‑1‑1978; and whether the petitioner was not being unreasonably discriminated against, as others named by him in similar situations were granted exemptions from passing the same promotion examination.

SHAFIUR RAHMAN, J.‑‑Leave to appeal is granted under Article 212(3) of the Constitution to examine the following questions of law arising in the case:‑‑ (1) Whether the pro forma promotion of the Petitioner in Grade‑17 w.e.f. 12‑1‑1978 had been made subject to his passing the promotion examination when no such examination was prescribed for promotion under the Rules as on 12‑1‑1978? (2) Whether the petitioner is not being unreasonably discriminated against, as others named by him in similar positions were granted exemptions from passing the same promotion examination?
2. In view of the short legal questions being involved, let the respondent furnish its comments on these two points and the appeal be made ready for additional documents. In the meantime, the condition of passing the promotion examination shah remain in abeyance. AA./M‑1316/S Leave granted.
