Criminal Miscellaneous No. 1 of 1985 in Criminal Revision No. 197 of 1985, decided on 3rd November, 1985. ‑‑‑S . 426‑‑Penal Code (XLV of 1860), S . 307‑‑Suspension of sentence‑ Case of short sentence of 4 years‑‑Accused behind bar since five months‑‑Sentence suspended. Ch. Ashraf Azim for Petitioner. Tasaddaq Hussain Jilani, A.A.-G. for the State. The petitioner has been convicted under section 307 , P.P.C. and has been ordered to suffer R.I. for four years and a fine of Rs.5,000 and in default thereof to undergo R.I. for one year.
2. The petitioner has moved a petition for the suspension of the sentence on the ground that the term of sentence is short. The petitioner is in jail since 10‑6‑1985. Since it is a case of short sentence, I allow bail to the petitioner in the sum of Rs.30,000 with two sureties in the like amount to the satisfaction of A.C. /Duty Magistrate, Khanewal till the disposal of his appeal. H.A.K. Sentence suspended.
