(On review from. the judgment dated 17‑11‑1991 of the Supreme Court of Pakistan in Civil Appeal No.263 of 1988). ‑‑‑‑O. XXVI, R. 1‑‑‑Review of judgment of Supreme Court‑‑‑Ground for review was that Supreme Court had overlooked order of Chief Settlement Commissioner to the effect "to transfer alternate accommodation to petitioner"‑‑‑Petitioners being displaced persons with verified claim and having been locked in litigation for the last thirty years vainly trying to secure implementation of order of Chief Settlement Commissioner were clearly entitled to transfer of some evacuee property in lieu of their verified claim‑‑ Settlement authorities were directed to transfer some evacuee property which was still available in favour of petitioners.

Date of hearing: 21st January, 1992. NASIM HASAN SHAH, J: ‑‑The only ground pressed in this case is that this Court overlooked the order of the Chief Settlement Commissioner dated. 25‑2‑1961 to the effect. "Please ask the Additional Settlement Commissioner, Lahore, to transfer as alternate accommodation to Syed Muhammad Hussain." Accordingly, even if the petitioners herein, for any reason, could not be transferred the building housing the school they are at least entitled to the transfer of some evacuee property in lieu of their verified claim. There is force in this submission. The petitioners are displaced persons with a verified claim and have been locked in litigation for the last 30 years vainly trying to secure implementation of the above order of the Chief Settlement Commissioner. The petitioners are clearly entitled to transfer of some evacuee property in lieu of their verified claim and the Settlement authorities should now take energetic steps to transfer some evacuee property which is still available and transfer the same in their favour. With these observations this review petition is disposed of. A.A./A‑930/S Order accordingly:
