Judgment & Decree
Ch. Mushtaq Ahmad Masud for Petitioner. I have seen the order of the Commissioner and heard the petitioner and his counsel. The petitioner obtained two lots namely: Lot 11 area 22 acres 14 marlas, and Lot No. 4, area 49 acres 6 kanals 7 marlas in 1968 on 10 years lease scheme. He deposited Its. 885 for Lot No. 11 and Rs. 2,958.75 for Lot No. 4 both on 27‑9‑
68. According to the petitioner he had to go to U. K. for some urgent work and had entrusted the work of developing the land to his brother, who apparently failed to take any inte rest. The petitioner however, claims that he has come back now and is anxious to invest money on developing this land. He also stated before me and supported the statement with an affidavit that the area has not been leased out to any body else, but that it is still in his possession. The petitioner is anxious to pay the defaulted amounts with penal interest. In view of the anxiety of the petitioner to hold on this land and to develop it, I see no objection to his continuing as the A allottee of this land provided:‑ (a) He pays the balance amounts due along with penal interest due within one month; and (b) Produces Bank guarantee or makes other financial arrangements to ensure that the payment of the Government dues for the future instalments would not be defaulted and that the Government dues for the future would be paid on time. Orders may be issued and parties may be informed accordingly. Order accordingly.
