Ss. 25-A, 36 & 38(3-a)--Practice and procedure--Consolidation of petitions--Petition becoming infructuous because of retirement of petitioner--Labour Court, held, has no jurisdiction to consolidate such infructuous petition with other pending petition of petitioner--Order of Labour Court set aside in revision by Appellate Tribunal in circumstances. Syed Qamaruddin Hassan for Applicant. First case bearing No. 149 of 1985 under section 25-A of I. R.O., 1969 has become infructuous because the worker Bakhtiar Khan was retired on 6-11-1985 and the Labour Court has no jurisdiction to consolidate Application No. 149 of 1985 and Application No. 64 of 1986 filed by Bakhtiar Khan. Consequently, the order, dated 3-9-1986 of A the Labour Court be set aside. Let the Application No. ' 64 of 1986 under section 25-A, I.R.O. 1969 may be proceeded and both the parties may lead their evidence in the said case. A.E. Revision accepted.
