Judgment & Decree

Rana Abdul Majid for Petitioner. Mian Muhammad Abbas for Respondent. Mst. Taj Mehal, petitioner, earlier filed Criminal Miscellaneous No.995/H of 1994 in this Court which was dismissed for want of sufficient particulars of the alleged abductor.

2. This is second petition in this Court. On 4-12-1994, S.H.O. Police Station RA. Bazar, Lahore was directed to recover the alleged detenus and A produce them before this Court on 19-12-1994. The S.H.O. is present. He states that he made all his efforts for the recovery of the alleged detenus but without success.

3. Serious allegation of abduction has been levelled against the respondent. The petitioner may, if so advised, approach the S.H.O. Police Station RA. Bazar, Lahore Cantt. who in turn is directed to record the statement of the petitioner under section 154, Cr.P.C. and proceed in the matter in accordance with law. With these directions, this petition stands disposed of.

During the course of hearing, it was announced that the order would be made at 1 p.m. On this learned counsel for the petitioner started shouting and stressed that the order should be announced just now. I told the learned counsel that after going through the previous petition and in order to save the public time, the orders will be made at 1 p.m. but the attitude of the counsel was again the same. I warned him not to repeat such words and stress upon the Court. At this stage learned counsel who were present in the Court stood up and apologised on behalf of learned counsel for the petitioner. Even then learned counsel for the petitioner kept on shouting and pressing the Court for announcement of the order just now. The counsel was again warned but he uttered that "I am ready to face the contempt proceedings". The attitude and conduct of the learned counsel was derogatory and amounted to interference into process of the Court.

Issue notice to Rana Abdul Majeed, Advocate 38-Nabha Road, Lahore, to show cause as to why proceedings under section 228, Cr.P.C. read with Article 204 of the Constitution of Islamic Republic of Pakistan and section 3 of Contempt of Court Act be not initiated against him. Reply to be filed within three days. .

6. The contempt matter now to come up on 22-12-1994. O.S.D.(Judl.) will ensure service of the notice Dasti today. N.H.Q./T-98/L Order accordingly.
