Civil servant having been appointed as Appellate Assistant Commissioner of Income-tax, in Azad Jammu and Kashmir claimed BPS-19, on the ground that Azad Jammu and Kashmir Council had adopted scheme of Basic Pay Scales of civil employees of Federal Government; post of Appellate Assistant Commissioner in Pakistan was placed in BPS-19, Therefore, he being Appellate Assistant Commissioner should be placed in BPS 1
Adaptation of basic pay scales of Government of Pakistan by Azad Jammu and Kashmir Council did not necessarily give benefit of equivalence of the post in Pakistan to the equivalent post holder under Azad Jammu and Kashmir Council, as the adaptation of pay scales entitled incumbent of the post to draw pay of the scale his post was borne on and adaptation of pay scales did not upgrade his post if it was borne on the lower pay scale than that under Government of Pakistan
