Judgment & Decree
(a) Criminal Procedure Code (V or 1898)‑‑‑ ‑‑S. 497‑‑‑Bail, grant of‑‑‑Principles‑‑‑Court, at bail stage, had only to see whether accused was connected with, the commission of crime or not and for that purpose, only tentative assessment of evidence was to be made and deeper appreciation was not called for‑‑Mind of the Court had to be satisfied that case was fit for grant of bail in line with guidelines covering legal requirements. (b) Criminal Procedure Code (V of 1898)‑‑‑ ‑‑‑‑S. 497‑‑‑Penat Code (XLV of 1860),, Ss.324/34‑‑‑Bail, grant of‑‑ Accused though had been nominated as one of the accused persons in the report lodged at the instance of complainant, a specific role of firing had been attributed to him and he remained fugitive from law for more than a year, but four persons had been charged for the single injury on the person of injured which was declared simple by Medical Officer‑‑‑Two co‑accused who had participated in the commission of offence, had already been released on bail on basis of compromise‑‑‑Complainant was absconding in another case‑‑‑Accused could not be kept in jail till arrest and trial of complainant‑‑‑Mere fact that accused remained in hiding, by itself, was not sufficient to withhold from him concession of bail‑‑‑Was not an absolute rule that a fugitive should under no circumstances be enlarged on bail‑‑‑Accused Was admitted to bail, in circumstances.
