Judgment & Decree
R. A. MAHAMMADI.‑
The order appealed against reads as under :‑ "This Public Carrier was detected by the P. T. C. carrying 28 persons. It was unanimously resolved by four votes to nil that Route Permit No. 182 be cancelled". This order was passed under Serial No. 23 of Item 17 (a) of the meeting of the R. T. A., Rawalpindi held on 17th Decem ber 1956. It has been urged on behalf of the appellant that this order is both excessive and discriminatory. I am inclined to agree that, in the circumstances of this case, there is substance in this contention of the appellant. In a similar case, I find, for carrying 18 persons, the same authority at the same meeting, only suspended the Route Permit of truck No. PBR‑7364, for one month, vide order under Serial No. 10 of item 17 (a). The ends in view would be met, I think, if the Route Permit of the appellant is in all suspended for three months. I, therefore, modify the order appealed against to this extent and order accordingly. K. M. A. Order modified.
