Criminal Procedure Code (V of 1898)-- .

S. 154--Provisional Constitution Order (1 of 1981), Art. 9--Registration of criminal case--Constitutional petition requiring registration of case disposed of with direction to petitioner to approach Superintendent of police who would look into his grievance and if information given by petitioner disclosed commission of cognizable offence he would direct registration of case against person found to be at fault.

Judgment & Decree

Report of the S.P. Gujrat has been perused. According to the S.P. the petitioner had not approached him nor submitted his medical report to Support his contention with regard to the alleged maltreatment, torture or snatching of Rs.3,500 from him by respondent No.l (S.H.O., P.S. Karrianwala). In this view of the matter the petitioner is directed to approach the S. P. Gujrat who shall look into the grievance of the petitioner and proceed in accordance with law. If the information given by the petitioner A prima facie disclose the commission of some cognizable offence, the S.P. Shall direct the registration of the case against the persons at fault. Meanwhile, there shall be no harassment by the aforementioned S.H.O. A.A. Order accordingly.
