Civil Procedure Code (V of 1908)‑ S. 24‑Transfer of civil cases‑Neither respondent nor his counsel appearing to oppose application‑Transfer of case allowed. Ali Ahmad A wan for Petitioners. Nemo for Respondent. Date of hearing: 16th March, 1981. This case was fixed for hearing on 11‑3‑1981 but since none appeared on behalf of the respondents, therefore, it was adjourned in the interest of justice. Today again neither his counsel nor the respondent himself has appeared to contest the application. The names of Messrs Balagh Haider and Khakan Babar, both have been shown in the cause list as counsel of the respondent but none has appeared since morning. It means that the respon dent is not interested in opposing this application.
2. In the circumstances the petition filed under sections 31, 32 and 33 of the Arbitration Act, 1948 read with section 12(2,), C. P. C. by the petitioners in the suit titled Mst. Sharifan v. Anwaar Muhammad and another pending in the Court of Syed Sultan Ahmad, Civil Judge, Jauharabad, District Sargodha, is hereby withdrawn from that Court and is transferred `I to the Court of Mr. Muhammad Ashraf Bhatti, Civil Judge, Lahore, so as to be beard alongwith the case titled Anwaar Muhammad v. Bashir Muhammad etc. The present application' stands accepted with no order as to costs. M. Y. H. Case transferred.
