Allotment of Government residence-- Cancellation of allotment on the basis of allegation of subletting by allottee.-- Petitioner (complainant) was ordered by High Court to be allotted that premises on vacation by previous allottee according to rules. Majid Hussain Chaudhry for Petitioner. Muhammad Anwar Bhour, Asstt. A. G The petitioner alongwith his learned counsel is present. Comments have been filed. The petitioner has pointed out in his application dated 14-4-1997 that since the allottee of quarter No.7-C, Johar Town Colony, Lahore has constructed his own house, the said quarter be allotted to him. The Additional Chief Secretary, Punjab, Lahore ordered that subject to vacation the quarter mentioned in the petitioner's application be allotted to him. The representative of the Estate Office admits that this quarter was pointed out by the petitioner and on his information the previous allottee Muhammad Hayat has been given notice to vacate this quarter as it is alleged that he had sub-let the same. According to the Estate Office representative it has been proved that Muhammad Hayat, the previous allottee, has sub-let the quarter.

2. The petitioner had originally applied for the residential quarter on 26-11-1987 and his application was registered at serial No.271-S. He is still waiting for the allotment of the residential house/quarter and has pointed out quarter No.7-C, Johar Town Colony, Lahore. It has been urged that it is the previous allottee Muhammad Hayat who has sub-let this quarter to some-body else which justifies the cancellation of his allotment for which notice has also been issued to him, This quarter, i.e., 7-C, Johar Town Colony, Lahore is to be vacated on the information given by the petitioner, therefore, he has the prior right of its allotment and accordingly the Additional Chief Secretary, Punjab on 14-4-1997 has also ordered that 'subject to vacation the quarter be allotted to the petitioner.

It is, therefore, directed that on the vacation of quarter No.7-C, Johar Town Colony, Lahore by Muhammad Hayat, its previous allottee, same shall be allotted to the petitioner in accordance with direction given by the Additional Chief Secretary, Punjab on 14-4-1997. With this direction, this writ petition stands disposed of. C.M.S./H-28/L Order accordingly.
