Headnotes / Summary

Candidate whose landed property is too paltry cannot be appointed even though law of primogeniture be in his favour. Petitioner in person.

Judgment & Decree

The Collector's report makes quite clear that the landed property of the petitioner is too paltry to justify interference at the present stage. There is no doubt that the law of primogeniture is in favour of the petitioner but his holding was so small that the Collector had to pass over his claims. He has acquired a little more land after the Commissioner had dismissed his appeal, but even this acquisition does not help him to make his holding adequate. In the above circumstances, I dismiss this petition for revision. K. M. A. Petition dismissed.
