Judgment & Decree
R. A. MAHAMMADI.‑
The order appealed against in this case starts from the assumption that the appellant had t6 maintain a reserve fleet of 25 /0. Secretary, R. T. A. has not been able to show me any legal provision under which such a direction could be given. He has pointed out that operators have been asked to maintain this reserve of 2500 under letter No. 9236‑T5‑55/9707, dated the 11th October 1955 of the Provincial Transport Controller of the former Punjab. This letter, at the very beginning, concedes that there is no direct provision in the existing law to this effect. As such, the remaining part of the order appealed against also does not stand. Accordingly I uphold the appeal. K. M, A, Appeal accepted,
