Criminal Appeal No. 16 of 1988, decided on 9th March, 1988. ‑‑‑S. 426‑‑Penal Code (XLV of 1860) S. 304‑A‑‑Suspension of sentence‑‑Father and brother of deceased filing affidavits to the effect that they had forgiven accused‑‑Both of them present and testifying contents of affidavits‑‑Nobody on behalf of State appearing to oppose prayer for suspension of sentence‑‑Sentence suspended. Mehar Ghulam Ali Mubashar for Petitioner. This is a petition for suspension of sentence on behalf of Muhammad Akram who has been convicted under section 304‑A, P.P.C. and sentenced to R.I. for five years and a fine of Rs. 10,000 or in default in the payment thereof to suffer further R.I. for six months. This is his second petition for suspension of sentence. The first petition (Crl. M. 1 of 1988) previously filed by him, was dismissed by this Court on 13‑1‑1988.
2. The fresh ground urged for suspension of sentence is that Mehboob Elahi, father of Ali Akbar alias Ghaffar deceased, and latter's brother Abdur Rehman have forgiven the petitioner/appellant. Affidavits of aforesaid Mehboob Elahi and Abdur Rehman have been placed on the file. Both of them are present and testify the contents thereof. Nobody on behalf of the State has appeared to A oppose the prayer for the suspension of sentence. In the circumstances, the sentence of the petitioner is suspended subject to his furnishing security in the sum of Rs. 25,000 with two sureties in the like amount to the satisfaction of Assistant Commissioner, Sargodha. M.Y.H./M‑624/L Sentence suspended.
