(On appeal from the order dated 13‑2‑1996 of the Lahore High Court, Lahore passed in Writ Petition No.60-R of 1995). ‑‑‑‑Ss. 10 & 11‑‑‑Constitution of Pakistan (1973), Art. 185(3)‑‑‑Dispute relating to evacuee nature of property in question‑‑‑Leave to appeal was granted to consider whether shops in question were constructed and owned by non‑Muslim evacuee and as such were evacuee properties.

We have heard the learned counsel of the petitioner at considerable length and grant leave to appeal to consider whether the shops bearing No.B-682, B-683 and B-684 were constructed and owned by Chandar Parkash evacuee and as such were evacuee properties. A.A./M-2/S Leave granted.
