Judgment & Decree

1. This order shall dispose of Appeal No. 30 of 2006 filed under section 33 of the Securities and Exchange Commission of Pakistan (the "Commission") Act, 1997 against the order dated 7/02/06 (the "Impugned Order") passed by the Respondent No.1. The appeal was fixed for hearing previously on 11/10/11, 15/11/11, 11/1/12, which were adjourned on the request of the Appellant. The appeal was re-fixed for hearing on 1/1/15, however no one appeared on behalf of the Appellant. In the interest of justice a final opportunity of hearing was provided to the Appellant on 9/3/15. The appeal was called for hearing at 10:00 am; the department representative was present, however, no one appeared on behalf of the Appellant before the Bench and no request for adjournment was received by this office. The matter was kept pending till the close of official timings however the Appellant failed to enter appearance despite repeated calls. From the conduct of the Appellant it appears that he is not interested in pressing the present Appeal, therefore, the Appeal is dismissed for non-appearance and non-execution.
