‑Student admitted to College "being a dependent brother of a lecturer in the College"‑Lecturer subsequently resigning from his post and consequently student also expelled on allegation that his brother had "deserted his duties without proper‑ intimation to the College"‑Contention that penalising student for action of his brother not justified‑Special Leave to Appeal granted to consider contention Petitioner in person.
Judgment & Decree
ABDUS SATTAR J.‑The petitioner was admitted on the 7th September 1968, in the First Year Engineering Class of N. E. D‑, Government Engineering College, Karachi when his brother Mr. S. M. Aziz was working as a Lecturer in Civil Engineering in that College. Mr. Aziz resigned on the 12th September 1968. On the 7th October 1968 the Principal of the College passed an order withdrawing the admission offered to the petitioner as the same was given to him "being dependent brother of Mr. S. M. Aziz" who deserted his duties without proper intimation to the College. This order was challenged in a writ petition filed in the High Court of West Pakistan at Karachi.. It was dismissed in limine by a Division Bench. It is contended that under the rules of the College a student can be expelled only if he is guilty of "breach of rules or misconduct, irregularity in time keeping, idleness, lack of reasonable progress in studies etc." as provided in para. 18.2 of the Prospectus. It is they: submitted that the rules of the College do not provide for penalising a student admitted as dependent of a Member of the staff after the said Member leaves the College. There is considerable force in the contentions. Leave is granted. Security in the sum of Rs.
250. No separate record for the appeal is necessary. The parties, however, may file certified copies of such other documents on which they want to rely. The appeal will be heard at Karachi. The operation of Order No. OS/NED/(19)/68/3169 dated 7‑10.68 is stayed pending the disposal of the appeal. Leave granted.
