S.497/498--Offence of Zina (Enforcement of Hudood) Ordinance (VII of 1979) , Ss. 10 & 16--Bail--Medical report showing abductee to be used to cohabitation although first informant stating in F.I.R. that she was unmarried--No material available for time being to connect accused with offence of Zina--Case against accused appearing to be of further inquiry- Bail granted. Muhammad Bashir Khan for Petitioner. Javed Iqbal Adam for the State. Petitioner is accused of offence under sections 10 and 16 of Ordinance VII of 1979. It is alleged that petitioner alongwith Manzoor abducted Mst. Shamshad and petitioner committed Zina with her during the time she lived with him. 2. Abductee is stated to have been recovered from the house of her mother's sister. According to the medical evidence she is used to cohabitation although the first information stated in the F.I.R. that she has not yet been married. The case against Siddique, petitioner, appears to be of further enquiry because there is no material at this stage to connect him with offence of Zina. He is in custody since 10th May, 1983 and his person is no longer required for further investigation. Therefore, he is allowed bail subject to his furnishing security in the sum of Rs.10,000 (Rupees ten thousand only) with one surety in the like amount to the satisfaction of Assistant Commissioner, Dera Ghazi Khan. M.Y.H. Bail granted.
