Judgment & Decree

Mrs. Asma Jahangir for Petitioner. Farooq Bedar, Addl. A.-G. for the State (on Court call). Irshad Ahmad Oureshi for Respondent No.1. All other matters pertaining to this petition stood resolved by 20-6-1989 and the only sore point left was the recovery of one Javed Masih who, according to the petitioner, was a worker at the Bhatta of respondent No.l and was not traceable.

2. This Court had earlier directed the S.1. of Police Station Saddar, Sheikhupura, to recover the said detenu and to produce him before this Court. His alleged efforts bore no fruit and having noticed the performance of Rashid Ahmad S.I. in my order dated 17-7-1989, 1 had directed that the S.P. of Sheikhupura shall personally look into the matter and if the alleged detenu was not traceable by the next date of hearing, then the S.P. shall personally appear before this Court to explain the circumstances of this default on the part of his subordinate officials.

3. The Superintend of Police, Sheikhupura is present in .Court. He states that further efforts were made for tracing the whereabouts of the said Javed Masih and that he has not been recovered. The S.P. further submits that he be allowed to register a case in respect of the alleged disappearance, abduction and secret confinement of Javed Masih aforesaid so that the real facts could be unearthed. 4. 1 appreciate the suggestion made by the S.P. Let a case under the relevant provisions of law be registered and I have no doubt in my mind that the S.P. shall depute x responsible senior official of his force to investigate the said case.

5. In this view of the matter, this petition has served its purpose and is disposed of as such in the above terms. N.H.Q./M-1701/L Order accordingly.
