‑‑‑S. 497‑‑Penal Code (XLV of 1860), ‑ S.302/307/148/149‑‑Bail‑‑Accused according to medical certificate was suffering from acute heart disease and diabetes having a foot ulcer and was admitted. in Coronary Care Unit of emergency block of Hospital and being presently critically ill needed constant monitoring‑‑Accused was admitted to bail for one month in view of the medical report with the discretion to the concerned Registrar of the Hospital to forward the last medical report of the accused before the expiry of one month. Judgment & Decree
S.M. Naeem for the State. Hamid Rashid petitioner alongwith four others stands charged with the murder of Zaigham, Abdullah and Khan Muhammad and for making murderous assault on Idrees, Allah Ditta and Abbas Khan on 17‑12‑1986 with fire‑arm. The occurrence was sequel to the registration of a criminal case against Zaigham deceased and Abbas Khan injured P.W. for making a murderous assault on the complainant party. The petitioner is alleged to have raised a Lalkara exhorting his companions to resort to firing. The shot fired by him hit Zaigham Hussain deceased. 2. Bail is mainly claimed on the ground of sickness of the petitioner and the fact that despite his arrest in the month of January, 1987 the trial has not come to an end. 3. The petitioner is presently admitted in C.C.U. Mayo Hospital, Lahore as a heart patient. His medical examination report is to the following effect: "This is to certify that Hameed Rashid son of Haroon Rashid is currently admitted in the E/CCU with acute myocardial infarction and left ventricular failure and pericarditis. He is also suffering from diabetes mellitus and a foot ulcer and diabetic neuropathy. He is presently critically ill and needs constant monitoring in the cornonary care unit of the emergency block, Mayo Hospital, Lahore." 3. In view of the above medical report I admit the petitioner to interim bail in the sum of Rs.1,00,000 with two sureties in the like amount to the satisfaction of D.R.(J), Lahore High Court, Lahore for a month. The matter shall come again for consideration before the Court on 25‑3‑1989. Registrar C.C.U. Emergency, Mayo Hospital, Lahore is directed to forward the last medical report of the petitioner on or before 20‑3‑1989‑ If the petitioner is discharged earlier then he would forward the last report to this Court through Deputy Registrar (Judicial), Lahore. N.H.Q./H‑117/L Bail granted.
