MUHAMMAD AFZAL ZULLAH,.J.‑‑A civil suit having been decided against the petitioners's side under Order `.'III, Rule 10, C.P.C., on account of non‑submission of written statement. Their appeal was also dismissed. The High Court having dismissed their civil revision as well, they have now sought leave to appeal. After hearing the learned counsel, we consider it a fit case for grant of leave to appeal to examine whether the learned lower Court, acted in accordance with the law declared in Sakhawatuddin v. Muhammad 1,1ba1 1987 SCMR 1365. Leave to appeal, accordingly, is granted. The appeal shall be, prepared on the present record with direction to the parties to file all necessary documents. M.Y.H./S‑201/S Leave granted.
