‑‑‑‑S.497(2)‑‑‑Penal Code (XLV of 1860), S.337‑A(ii)/147/148‑‑‑Bail, grant of‑‑‑Accused and their co‑accused were attributed indiscriminate beating by Sotas without specifying as to which particular injury was caused by whom‑‑ Accused party had also filed a private complaint against the complainant party accusing them of aggression‑‑‑Court after trial was to decide as to which party was aggressor‑‑‑Case against accused was one of further inquiry and they were allowed bail accordingly. Qazi Muhammad Saleem with Taseer Saleem Qazi for Petitioners. Malik Suleman Awan for the State. The petitioners seek bail in case registered through F.I.R. No373 of 1993 at Police Station Malakwal, District. Mandi Bahauddin under section 337‑A‑ii/147/148, P.P.C., against them and three others for causing injuries to Khan Hafeez. The petitioners party has also filed private complaint. Their case was that the complainant party in the instant case was the aggressor. Seven injuries, allegedly sustained by Imtiaz Ahmad. Petitioner No.1, have not been explained in the F.I.R. The case of the respondent/complainant party was that the same were self‑inflicted injuries. Some of the said injuries are on the vital parts of the body such like forehead and nose.
2. In the present F.I.R. indiscriminate beating by Sotas by the petitioners and others have been attributed without specifying as to which particular injury caused by whom.
3. It is yet to be decided by the Court after trial as to which of the party is aggressor. The case of the petitioners is of further inquiry and falls under section 497(2), Cr.P.C. The petitioners are allowed bail in the sum of Rs.30,000 each with one surety each in the like amount to the satisfaction of A.C., Mandi Bahauddin. Disposed of.
