Application for grant of `B' .Class in prison during pendency of appeal

Held. accused being an educated person with no criminal record who was leading a decent life and was not involved in a heinous crime, his application for `B' Class in the prison was granted till the disposal of the appeal. Usman Ghani Rashid for Appellant. M. Zubair Qureshi, AA.- G. for the State., HAZIQUL KHAIRI, J.--This is an application under section 561-A, Cr.P.C. in which the appellant has prayed that he may be granted `B' Class in prison till the disposal of the appeal. It is an admitted position that the appellant was an Officer Grade II and Incharge of Foreign Exchange Section at the Nicol Road Branch of National Bank of Pakistan and was charged of misappropriation. Learned AA.-G. concedes that the appellant is an educated person and was enjoying a respectable position in the Bank but he opposes this application on the ground that he should be treated like other criminals. Mr. Usman Ghani Rashid learned counsel for the appellant on the other hand states that the position and status of the appellant may be taken into consideration and that the appellant may not be equated with other criminals. However, in view of the fact that the applicant is an educated person with no criminal record and was leading a decent life and is not involved in a heinous crime, we are inclined to grant this application and grant `B' Class to him till the disposal of the appeal.
