2. Exemption is granted for the time being.
3. The applicant seeks bail in a case under section 13(d) of the Arms Ordinance, 1965 and section 7(c) of the Surrender of Illicit Arms Act, 1991 (Crime No.117 of 2001 of Police Station, Mahi Makool). The prosecution case is to the effect that the applicant was seen slipping away from his house with an unlicensed SBBL gun and ten live cartridges when a police partly went to conduct a raid on the applicant's house on 8-7-2001 in consequence of the instructions from superior officials to recover unlicensed weapons. It is contended by Mr. Nisar Ahmed Abro that it is yet to be determined whether the offence would fall under the provisions of section 13 of the Arms Ordinance, 1965 or under the Act of 1991. Mr. Altaf Hussain Surahio, learned State counsel is already present in Court in other matters. He is put on notice and states no objection to the bail plea. In view of the above, bail is granted to the applicant subject to his furnishing a solvent surety in the sum of Rs.50,000 and P.R. bond in the like amount to the satisfaction of trial Court.
